El presente trabajo tiene por objeto una visión crítica de la actual situación de la regulación del ejercicio profesional en la actividad física y el deporte en España. La renuencia estatal a proceder a la misma ha determinado la aprobación de leyes autonómicas (Cataluña, La Rioja y Extremadura) que la han llevado a cabo. Si bien estas actuaciones autonómicas han sido saludadas con gran aceptación en el sector profesional del deporte, en nuestra exposición se pone de manifiesto la dificultad de su encaje en el marco de la distribución competencial que establece la Constitución, a partir del momento en que es el Estado quien tiene la competencia exclusiva para la regulación de las profesiones tituladas. Se determina así el análisis de las indeseadas consecuencias que ello puede deparar: la posible inconstitucionalidad de estas normas; la perpetuación del problema que supone una regulación carente de conexión entre las distintas titulaciones con un ámbito profesional que les sea propio, así como su potencial efecto desintegrador sobre la unidad del mercado profesional en este sector. De ahí que se concluya la necesidad de una regulación profesional estatal como el único cauce posible para superar estas distorsiones.

Abstract

The aim of this study is to provide a critical view of the present situation of the regulations of the professional practice in physical activity and sport in Spain. The state reluctance to proceed with the regulations has resulted in the passing of regional laws (Cataluña, La Rioja and Extremadura) that have carried out this regulation. Even though these regional proceedings have been received with great acceptance in the professional sports sector, in our report we will make clear that these regulations cannot easily fit into the framework of the distribution of competencies established by the Constitution, since the State has the exclusive responsibility for the regulation of skilled occupations. Thus, we determine the analysis of the unwanted consequences that it may bring: the possible unconstitutionality of these rules; the perpetuation of this problem which would imply a regulation lacking a connection between the different qualifications and its own professional field, and their potential and disintegrative effect over the professional market unit in this sector. That is why there is the need for a state professional regulation as the only possible course of action to overcome these distortions.
